Richard Epstein’s new book is classic Epstein: erudite, eclectic, and unconventional to the point of being revolutionary. It is filled with blunt pronouncement, flashes of brilliance, and a characteristic willingness to criticize even political allies. But in the end, it fails in its mission to resurrect and defend the American constitutional landscape as it existed before 1937.
